TERMS AND CONDITIONS OF SALE

1. Introduction

Please read these Terms and Conditions of Sale carefully before placing an order.

By placing an order through this website, you expressly agree to be bound by these Terms and Conditions of Sale, including the provisions relating to warranty and liability.

2. Definitions

In these Terms and Conditions:

  • “we”, “us”, “our” refer to Pedretti Gaming;

  • “you”, “Customer” refer to the individual or legal entity purchasing or intending to purchase products through the website.

3. Order Process

The presentation of products on the website constitutes an invitation to treat and does not constitute a binding offer.

Your order represents a contractual offer. The contract shall be concluded only upon our express acceptance of the order.

To place an order, you must:

  • add one or more products to the cart;

  • complete the checkout process and payment using the available payment methods only.

We reserve the right to refuse or cancel any order prior to shipment.

These Terms may be updated from time to time. Customers are advised to save or print a copy for future reference.
The governing language of these Terms is English.

4. Products

The products sold through this website consist of pinball machine parts and related technical components.

You are responsible for verifying that the products are lawful, compliant, and suitable for import and use in your country.

5. Prices and Payment

All prices are displayed on the website. Despite reasonable care, pricing errors may occur. If an incorrect price is identified, you will be informed prior to order processing.

Delivery costs are indicated during checkout.

Payment must be made in full at the time of order.
If payment is not received, reversed, or cancelled, we reserve the right to suspend delivery or terminate the contract.

6. Customer Representations

You represent and warrant that:

  • you have the legal capacity to enter into binding contracts;

  • all information provided during the ordering process is accurate and complete.

7. Shipping and Delivery

Products will be delivered to the address specified in the order.

We will use reasonable efforts to deliver:

  • by the delivery date stated in the order confirmation, or

  • if no date is specified, within 15 days from payment confirmation.

8. Transfer of Risk

Consumers

For Consumers, the risk of loss or damage passes only upon physical delivery of the goods to the Consumer or a third party designated by the Consumer.

Business Customers (B2B)

For Business Customers, the risk passes upon delivery of the goods to the carrier.

9. Right of Withdrawal (Consumers – European Union)

This Section applies exclusively to Consumers residing in the European Union, as defined under applicable consumer protection laws.

The Consumer has the right to withdraw from the contract without giving any reason within 14 (fourteen) calendar days.

Withdrawal period

The withdrawal period expires:

  • 14 days from the day on which the Consumer or a third party designated by the Consumer acquires physical possession of the goods; or

  • in the case of multiple goods ordered in one order and delivered separately, from the day of acquisition of the last good.

Exercise of the right of withdrawal

To exercise the right of withdrawal, the Consumer must notify Pedretti Gaming of the decision to withdraw by means of a clear written statement (e.g. email or contact form).

The Consumer may use the standard EU withdrawal form, but its use is not mandatory.

10. Effects of Withdrawal and Refunds (Consumers – EU)

If the Consumer withdraws from the contract:

  • all payments received, including standard delivery costs, shall be reimbursed;

  • reimbursement shall be made within 14 days from the day we are informed of the withdrawal;

  • reimbursement will be made using the same means of payment used for the original transaction, unless expressly agreed otherwise.

We may withhold reimbursement until the goods are received back or until proof of return is provided.

The Consumer must return the goods within 14 days from the communication of withdrawal.
The direct cost of returning the goods shall be borne by the Consumer, unless otherwise agreed.

The Consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

11. Exclusions from the Right of Withdrawal

The right of withdrawal does not apply in cases provided by law, including:

  • goods made to the Consumer’s specifications or clearly personalized;

  • sealed goods unsealed after delivery for health or hygiene reasons;

  • goods which are inseparably mixed with other items after delivery;

  • digital content not supplied on a tangible medium, once performance has begun with the Consumer’s express consent.

12. Returns and Refunds (Non-EU Consumers and Business Customers)

For non-EU Consumers and Business Customers (B2B), returns and refunds are not automatic and are accepted only upon prior written authorization.

If a return is authorized:

  • return shipping is at the Customer’s expense;

  • goods must be unused, undamaged, and in original packaging;

  • shipping costs, payment processing fees (including PayPal), customs duties, and taxes are non-refundable, unless mandatory law provides otherwise.

13. Statutory Consumer Rights

Nothing in these Terms shall limit or exclude any mandatory statutory rights granted to Consumers under applicable law.

14. Business Customers – Product Conformity

For Business Customers, products are warranted to materially conform to the technical specifications published at the time of delivery.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, fraud, or gross negligence.

Consumers

For Consumers, our liability is limited to the maximum extent permitted by applicable law, without affecting statutory consumer rights.

Business Customers

To the maximum extent permitted by law, Pedretti Gaming shall not be liable for:

  • indirect or consequential damages;

  • loss of profits, revenue, or business opportunities;

  • damages resulting from improper installation, misuse, unauthorized repairs, or modifications.

Total liability shall not exceed the amount paid for the products giving rise to the claim.

16. Product Safety and Intended Use

Products are intended for installation and servicing by qualified and skilled technicians.

Any installation, repair, or modification performed by unqualified persons is carried out entirely at the Customer’s own risk.

17. Force Majeure

We shall not be liable for delays or failure to perform due to events beyond our reasonable control, including natural disasters, strikes, supply chain disruptions, or governmental actions.

18. Contract Termination

We may terminate the contract with immediate effect if:

  • payment is not received in full; or

  • the Customer commits a material breach of these Terms.

19. Effects of Termination

Upon termination, we shall have no obligation to deliver undelivered products.
Any outstanding amounts shall remain payable where applicable.

20. Intellectual Property

These Terms do not grant any license or assignment of intellectual property rights relating to the products or website content.

21. Governing Law and Jurisdiction

These Terms are governed by Italian law.

  • For Consumers, jurisdiction shall be determined in accordance with mandatory consumer protection laws.

  • For Business Customers, exclusive jurisdiction shall be vested in the Courts of Bergamo (Italy).

23. Warranty and Repairs

Products are covered by a 24-month legal warranty for EU Consumers, starting from the date of purchase, against conformity defects.

During the warranty period, Customers must contact us to receive return instructions.
Defective products will be repaired or replaced.

For complete pinball machines, only defective components may be required to be returned.

The warranty does not cover:

  • direct or indirect damages caused by product failure;

  • incorrect or careless installation;

  • unauthorized repairs, modifications, or self-made fixes;

  • misuse or handling errors;

  • damage occurring after delivery due to Customer actions.

The commercial warranty applies to the original purchaser only and does not limit or exclude the statutory legal warranty.

Repairs must be performed exclusively by qualified professionals.
